They have set the precedent of paying for the SC picked up by the RSV. They have been doing it for almost 3 years so I don't know how they could claim they weren't aware of what they were doing. I don't think a clawback grievance would go in their favor.
No claw back but they’d prevail if/when they close that IT loophole. The contract verbiage would trump any grievance filed. Doubt grievance would even give it much priority.
Enjoy the IT shortcoming in that section of the UPA as long as it lasts.
