In short, depending on how you decipher the contract, yes the flow is being violated in the pilot/union's eyes and not from a company stand point. It's under grievance right now.

Yes, a new hire today is looking at 10 years to flow. Probably more to be honest. And that is barring no major industry shockwaves.
