Had the similar issue with a GE engine on an etops divert. We landed in EWR. Faa wanted to know why we continued to EWR and passed "suitable airports".

After a couple back and forths, issue dropped.
Etops alternate is a dispatch item. Nobody says that you must go there. I don't think the Feds will do anything
