Preventing embarrassment is not a legal justification for assault, unlawful detention, or kidnapping. If he admits that, he's going to jail.

For all we know the local jurisdiction already considered and rejected criminal charges due to lack of evidence or lack of a solid case.

There are jurisdiction issues here. Maybe her attorney wanted to sue the company and not the CA because he's admitted in WA, not MN. Anything between the two pilots, civil or criminal, would be in MN jurisdiction since that's where it happened. Employer/ employee matters would be in WA.
