That's the game. Civil trials have become a rare thing.
Plaintiff: These are horrible facts for you, you can't have this publicity, and you will get creamed at trial. I have you over a barrel, so get out your checkbook.
Defendant: We are going to wear you down and outspend you with discovery and motions. We will put your character on trial and we will destroy you in the end. If the checkbook ever comes out, it will have very few zeros.
