The 1st class privileges are required because all fleets fly internationally.
That is not a legal requirement. I know for a fact American and UPS, who fly international, can absolutely let their First class lapse for FO’s. So FO’s over 40 flying international (Caribbean, South America, Bermuda, etc) non augmented flights can absolutely lapse.
