Weren't both of these provisions written in with language saying either side could pull them down at any time for any reason? IANAL, but how is it bad faith to exercise an agreed upon provision in a contract? Does it reek of taking your ball and walking off the playground? Sure, but maturity has no place in contractual language, only the specific language with signatures at the bottom.
