In other words a 737 can’t be authorized to go 280 below 10 just because they felt like it. That would imply the ATC has authority to give permission which they do not.
There is no authorization request to exceed 250 when the minimum safe speed is above 250 however. The reg clearly authorizes exceeding the 250 limit without asking. So even if you ask the ATC they will only be only clarifying to you that you are already authorized by the regulating body. They themselves aren’t giving you permission as it was already given.
