I think the technicality they based the decision on was that you were not recalled to LCAL in 2012, you were hired by LCAL. You were still on furlough from LUAL.
I'm sure that was the exact reasoning at the time which was, and remains, absurd considering the merger occurred in 2010. LCAL and LUAL were the two sides of the same coin.
