Go read the applicable guidance on maintenance programs, MMEL and MEL approvals. If I've stated something contrary to the guidance please point that out and we'll discuss.
Also, go look at the data from various ASAP and VDRP programs and look up MEL violations by aircrew. It's surprising how many times trained and qualified crews flew a plane without understanding how to use the MEL.
FAA Order 8900.1 contains much of the guidance suggested, and gives links to other applicable orders and Notices.
