As I understand it, if we vote no, there is no arbitration. DALPA is only going to try to make this an issue if it's an actual issue. It's a smart move on their part - if they arbitrate now and they lose, then Delta knows that if we say no, they can still get their 35 RJs back just by starting a new regional. But if they wait and we say no, then Delta has to consider that they'd go to all the trouble of starting up a new regional only to have DALPA then challenge it on the same grounds of "we signed an agreement with Compass, and this new regional isn't Compass", have DALPA win, and then they've wasted all that time and money.
This is not true, Delta can still go to arbitration over LOA 9. They simply add back the 6 seats in our RJ’s, with a legal intent to operate a new regional to fulfill the provisions of LOA 9.
