If Delta repurchased the Compass certificate, and started it back up, the LOA 9 would be back in effect. The question is whether DL mgt can exclude DALPA from an agreement penciling in Endeavor’s name as another carrier, and whether that flow down had to be continuously available during that process. It would be a true statement to say that, no flow down could have been granted by another carrier during the pandemic under the CARES Act.
