Actually you can in aviation. Only difference is that the FAA sets the rules... get too old or too fat and they'll pull your medical. The courts have mostly taken medical fitness to fly out of the hands of the employers and left it solely in the FAA realm.

We kind of do that already, if you neglect your health badly enough the FAA will cancel you. The only question is a matter of degree... how fat is too fat?

The FAA actually tried to presumptively diagnosis all heavy-ish pilots with OSA a few years ago... that would have grounded a lot of people, but IIRC congress intervened and put a stop to it.
