I see how you could say that’s a grey area (22.D.6), but the only reference to the 365 is in the displacement section (22.F), and in that subsection, is says that it can be a 365 for the purposes of 22.F.1-4.
22.F.4. States “The last date upon which a
displacement can become effective may be extended beyond 210 days from its date of posting by mutual agreement between the Company and the pilot who hold the
VD or MD.”
To me, unless the people offered this were displaced to their positions (they weren’t), then the company can’t proffer that option.
