This is exactly why our 60-day expedited arbitration process has taken over 13 months. The arbitrator keeps sending us back to “work it out” because then he avoids making the decision.

1) He wants to rule for the company, since the NEA is clearly in everyone’s best financial interests, but on the other hand…

2) He can not rule in favor of the company, since that will set a precedent that will destroy scope everywhere.
