Does NK have to be out of the merger agreement by either it being voted down or by voluntarily pulling out for the tender to go through? Trying to figure out what NKs play is here. Frontier is never gonna match the cash amount of JB. I have the feeling our board painted themselves into a corner.
If B6 gets more than 50% tendered, then they have the majority shares. I don’t think the vote would happen at that point, even if it did it would be against frontier since B6 would have the majority. B6 would own NK. It would be a successful hostile takeover.
