Are there FAA and company requirements that dictate who may occupy an FA jumpseat? Of course. Is the captain always going to be the one facing the consequences if those requirements are not met? No, as long as you have fulfilled all of your responsibilities per the FOM.
Most of the verification responsibilities have been shifted to other people for cabin jumpseaters. For cockpit jumpseaters, yes, there are still a number of requirements that the captain must ensure are met.
