EWR is no longer slot restricted officially anymore. This is SK biggest beef with the FAA especially when they wanted United to cut back flights for runway work. When United did, JetBlue increased flights as a result and then United added back capacity.

FAA limited Newark to 79 flight-operations an hour under a Level 2 “schedule facilitated” classification. That 79/hour is a soft cap and and throughout the day the airport was scheduled for more than 79 flights per hour. Guess when those were? The 1600-1900 bank. Guess who over scheduled based on their 73% share? UA.
Scott and Jon Roitman, who was well over his head as COO, created a canard that JetBlue and Spirit, with 5% and 2% of the schedule, were the cause for congestion because UA couldn’t operated at EWR. I get it, I’d blame everyone else too.
