Hmm, I’m still not convinced … the Redeye blocks in from the west coast around 5:30 am with a 6ish hour duty period, then you spend all day (9 hours) in an airport hotel waiting for your DH leg back to base. There are flights available back to base starting at 7 am. Seems that this violates 8.D.3.
Did you read 8d3 exception? What's to be convinced about? There are 3 criteria for the exception, and if the pairing meets those 3 criteria, they don't put you on the earliest dh they give you a break in duty.
