If this arbitration is finally settled in our favor, we will be the only airline with 100% unstacked and no staffing model. That being the case, what does it matter which CBI we use? The current cbi can be set to simply honor seniority. I will give you that Merlot/CBI isn't the prettiest thing and has been buggy or feature incomplete in the past, ie not a mature product, maybe NavBlue addresses those items but what does it do that drives quality of life forward if cbi is no longer a factor?
