Maybe they figure it will be fine, let's just get out of here. Probably not the first time either, and when this happens, usually the pilot who gets busted is a known factor. They just finally pushed it too far.

Best approach is not to get hammered on overnights, and stop at a reasonable time, well before FAR limits.
