The issue is the contractual provision 8-c-8-b. It says “pilots who do not meet the requirements of FAR part 121.436 will not be eligible to be awarded or assigned captain vacancies.” That isn’t must meet the requirements of 121.436 before serving as pilot in command. Awarded or assigned a vacancy. That seems pretty limiting to me.
No one is arguing the hours requirement. A type rating is not necessary at the time of award.
