I did not know this was a possible outcome of a fatigue call. He has sent multiple DART to the union during this process as it plays out. Thank you for your reply and clarifications. I wrote this to put information out there to the rest you and find out whether it is occuring en masse, not saying it is in accordance with the CBA. Can the company get away with this? Yes they can. You are right, he can grieve it. Spend 5x the hours you wil get back from the trip just to try to reclaim your rightful pay, then lose the case. The company appears to want to discourage fatigue calls and make us all miserable until we vote in a concessionary contract. They claimed in ground school how wonderful our fatigue policy is and how it allows us to legalize difficult schedules. If you call fatigued you are at the mercy of the board ruling for or against you. The union wasn't much help. It looks like they sided with the company. This type of thing also occured during Covid when they were so understaffed. Screen shot your check in, then follow up to see what happens to your pay over the next month while you wait for the committee to rule.
Ok, so the details changed a little, but still don't add up. It sounds like your buddy called in fatigued during a hub turn, probably before the scheduled showtime for the trip. Maybe he checked in, maybe he didn't, only he and the company knows. The company doesn't make the decision of whether he is paid or not. The question is, what is actual check in. Is it show time, or when the pilot hits the check in button? The fact that your buddy doesn't want to spend the time to grieve it shows that they don't really care if the contract is being abused. It is that type of apathy that allows the company to interpret the contract how they want.

It is the details that matter when it comes to these types of situations, and there are many important details that are missing. Bottom line is, if you are faigued, call in fatigued. If you call in before showtime, your hours will most likely go into MU, not come out of your sick bank per the contract.
