That would be a very unfortunate irony if the judge ruled against the JB/Spirit merger in order to keep competition in the ULCC space and Spirit goes under as a result. I haven't really followed Spirit at all but I thought they had a pretty firm business model. However it seems things aren't so hot over there right now.
