Outside of bankruptcy it shouldn’t be a problem going forward. And make a furlough more expensive in the long run compared to 911 furlough provisions.
Yeah I know a lot of folks from AA/TWA/USA who turned down last recall because they had a job with some seniority/longevity and maybe had upgraded and would have taken a big cut in everything for the privilege of coming back. Would some of them be better off today if they had recalled? Yeah probably but they had no way of knowing that, we all knew pilots who got furloughed twice from UA in that era, and rumors were that some got furloughed three times
