Unless your backup flight(s) are all OAL, which is a common situation in some commuter cities.

You can fully comply with the rules (namely, the PWA commuter clause in 23.X) and still end up in this situation.

Neither the PWA nor the FOM policy are actually rules anyway. They simply describe a certain benefit that you can receive if you meet certain conditions. In the case of the PWA, the benefit is insurance against discipline if the commute falls through (even though your working flight may still end up delayed or canceled). In the case of the FOM policy, it’s positive space on your backup. If you don’t meet the criteria for either policy but still manage to make it to work on time, you haven’t broken any rule. Similarly, you can meet the criteria for only one policy but not the other, receiving only the one eligible benefit.
