CA is obviously wrong. Try filing another Crew Assist case, and cite PWA 23.S.9.b.2.b, "The pilot must be able to report for a rotation with a report as early as two hours after the start of the short call period". 23.S.9.b.2.d states "their line may contain a rotation with a report as early as two hours from the start of the short call period" Furthermore, "Report" is defined in 2.245 as "one hour before the scheduled departure"
If they still fail to do the right thing, file your STS. From what you wrote, 100% chance you get paid whatever your first FDP block+MU was, or 2:00 DP minimum.
This is exactly how to proceed. I had a similar issue that was denied. I followed up with the contract reference and was denied again. I filed an STS and received 9K a few months later. If the cost becomes a meaningful metric, the problem gets fixed. Until then CS will continue the deny, delay techniques.
I'll ask my reps for a delay penalty in the next contract. Does 2% per month seem reasonable or is that too low?
