the arbitration process is exactly the reason the company is violating so many sections of our contract. There is no penalty for them if they are ruled against and they will get wins like this along the way.
some of the regionals are very good at weaponizing the arbitration process and Delta seems keen to join that bandwagon.
I’ll also say that this (and the RJ arbitration) can be lessons for some pilots that think that negotiating settlements for violations is a bad or weak thing. It’s not always the right choice but many times it IS the prudent choice.
