I know guys who have air returned and not declared an emergency for an overweight landing. Just a simple write up to mx. Definitely seems prudent to err on the side of caution and just declare an emergency though.
At AAL, a landing over max structural landing weight requires the CA excercise emergency authority. So an Emergency must be declared if landing overweight.
