I don't quite understand MP's statement here. I did not see anything in the agreement that made the Company decide not to allow an excess into an FDA, because that is what is happening to you. You are a DC10 CA and want to bid HKG on an excess, I would argue that the Company has determined HKG CA is full and they are not allowing excess pilot to bid it.

The settlement reads that the restriction on excess into an FDA is allowed, but the Company can turn around and then declare an excess in the FDA if they so choose. This is all in reference to canceled awards, your issue is straight out of the CBA, MP is blaming the Union for requiring compliance with the CBA...

From the settlement:


The pilot’s excess status, however, shall not be limited by the prohibition in Section 24.C.6.c. The parties recognize that the Company may declare an excess at an FDA following the awards or assignments.

CBA

Except as provided in Section 24.C.6.b., a pilot who has been excessed, or who has bid to relieve an excess, shall be awarded another permanent crew position in accordance with his seniority and standing bid; provided, however, no pilot may be awarded or assigned a crew position at an FDA base that would cause an excess at that base.

The only way per the CBA they could award you HKG is if there are vacancies created by people bidding out since there are no primary's in this FDA on 08-02.

I just do not see how MP can put the blame on the Union for not allowing an excess into an FDA ?

BTW, your DC10 CA slot was not canceled, so you are correct you are simply bidding from the DC10 as an excess, not sure what other option you would have ?
