The company can’t change a pilot contract unless it’s in BK or the union agrees to it. If Spirit goes into Chapter 11 then they have to petition the judge to amend the PWA. The judge can say No!
depends whether the union believes Spirit can recover under any scenario. If it cannot, parting a newer fool from his money to fund a concessionary contract would be an excellent job transition plan for the union members
