I’m not trying to argue this- but where did you read this? I have gone through both companies’ contract comparison guides that have been recently published, and I cannot find any mention of contract compliance penalties. I also cannot find any mention of contract compliance penalties in our CBA. I’m not saying they aren’t there, or that any other airline doesn’t have a better process for enforcing the contract- I would just like to be able to read them for myself.
This is something that ALPA could produce for us to show how they will better support us for all of the money they would make off of a merger.
DL’s contract has a provision under the “Global Scope Agreement” for violations vis-a-vis JV’s. If the company is found to have any violations, WB positions are automatically posted in the next bid that are (effectively) nearly permanent. It’s a pretty solid gain.
Most of the rest of the contract is the standard “fly now grieve later”, but a big push in this cycle is for auto financial penalties when they fail to pay us properly the very first time. I fully suspect we will get some version of it. It’s a petty big issue over here right now.
