FAA stance is that the company can fire you for calling out fatigued. There is no FAA requirement for a good faith/no fault fatigue program. All FAA says is you have to be removed from duty if you call fatigued, everything after that is an employee/employer relationship issue, and FAA doesn't care about it.
Yet, we do have a fatigue program signed by the company, and if all you say is true, the pilot would still win in court if the company violates the agreement.
