Totally agree, however I guess I could also make the case that during negotiations there were no plans to go to assigned seating, so how much time and effort are you really going to put into ironclad language for deadheads in the event the company went to assigned seating? I'm glad they had the forethought to put anything in there at all under the circumstances.
Sounds like planning to fail.
Most other airlines have contractual language to put the pilots in the upgraded seats. Even American has it. They hold the empty seats up there and put pilots in them.
