This is what triggered the Reuters interview with Duffy. The Admin decided that they aren't going to pick winners and its going to take Congress to do a bailout of failing carriers. Hopefully something gets done before Spirit runs out of cash.
The real decisionmakers seem to agree there is no legal pathway to do this without Congress. That whole thing started when Trump made another off-script comment to fish for votes.
Using the DPA for Spirit was never a workable plan. That's as far of a legal stretch as his birthright citizenship "case".
Hope Trump et al. can come up with something that's actually possible instead of pushing forward with a plan that won't survive any legal scrutiny.
Spirit going out of business is not good for anyone.
