It is based on both seats & MGTOW (most major airline contracts are). The max in the JPWA is 86,000 lb. The CPS E-175 fleet will weigh 89,000 lb once the "AR" mod is certified. There was specific scope language carved out that allows CPS to operate 36 of them at that weight. Any new E-175 orders would have to be "LR" models which have a MGTOW of 85,517 lb.
