As part of Comair's first BK concession offer from management (March 2006), the pilot's no-furlough clause was removed.

When Comair MEC held T/A roadshows, some attorneys from ALPA National presented. One said that the no-furlough clause was useless at the regional level and not worth keeping. I believe his words were "indefensible in court".

He added that it wasn't worth the paper it was printed on if the company didn't have enough airplanes to justify the pilots. I got the impression ALPA National would not bother to fight that fight.

Long story short, the BK judge agreed with management and the clause went away.

Maybe ASA's ALPA National attorneys will be braver than Comair's ALPA National attorneys. After all, in 2006 ALPA wasn't "Takin' it back" yet.
