I am not a lawyer or a legal expert, but my understanding is that federal labor laws do not allow military Reservists to be discriminated against on account of their obligations as Reservists. If the Military did not have these protections then no one would be able to hold a job who was also serving part time in the Reserves. Refer to RickAir7777's post on this thread for clarification. The obvious implication is that Reservists must be protected from being fired simply because they are not available for scheduling as much as everyone else. However, if Ga Skies fired our guy for other reasons, such as failure to comply to FAA regulations or any of a number of other legitimate reasons, then he may be fired without legal repercussions.
Personally I hope that N6724G looks into this, because if Ga Skies is bold enough to fire people simply because they cannot make their schedule on account of Reserve duty, it is an egregious offense that needs to be addressed.
