Dude - tell me your kidding? This fella should have gotten his food, and not given it a second thought. Who cares if she was on duty - it is a free country, and she was exercising what we call freewill. It still makes me sick to see that there are so many "boy scouts" out there looking to be "that guy" the one that no one can stand because he thinks its his business to police anything he thinks "might" be outside of the rules. Unless the FA worked for his company, how does he even know what her companies FOM says about drinking in uniform. If you came up to me in while I was in uniform having a beer - I’d tell you to get lost.
