There may be a major problem with how courts are interpreting the law, but not with rickair's correct report about it. We had a similar situation at Delta some years back, and the court sided with management. The other side of this coin is that management cannot suddenly start enforcing company rules that they have customarily overlooked, in order to pressure workers. That would also be a change in the "status quo".
