Because their DL flying is on their Shuttle America & Chautauqua certificates. All of the flying they've aquired is either on their Republic certificate, or on the Midwest, Frontier certs. In the eyes of the FAA, and all else involved, all those entities are completely separate and individual.
Still, I can see DL telling RJET to take a walk when that contract comes up for renewal. And now that they have stated publicly that they intend to go after a market like LAX, I think DL will stay in it all year around just to compete.
