On a serious note, internships at no pay are a routine part of American business. I'm not so sure there is a legal challenge to this scheme.

An internship would not require responsible charge of anything; in this case and aircraft and student. If you have the responsibility of an instructor, you couldn't possibly be an intern. The intern would be the guy riding in the back of the plane learning how to instruct, and would provide support duties to the CFI on the ground. He or she would not be PIC
