I thought that the only reason why the judge decided that is because SWA management had a stipulation that SLI needed to be completed first and that since FAPA and SWAPA didn't complete SLI and SWA management didn't remove the stipulation, that their offer was invalid. In other words, if there would have been an SLI agreement between FAPA an SWAPA, the SWA offer would have been valid.
