Update:
MAG claims they have agreements with all but three parties concerning the rejection of leases and abandonment of aircraft, etc.
Those that do not object to the entry of MAG's Modified Proposed Orders are:
-Official Committee of Unsecured Creditors
-GE Capital Aviation Services
-Bank of Scotland, plc
-CIT Capital USA, Inc.
-DVB Bank SE
-Export Development Canada
-Fortis N.V.
-HSH Nordbank AG
-Landesbank Baden-Wurttemberg, Transamerica Aviation LLC
-NIBC N.V.
-Rolls Royce plc
-Bombardier Inc, Bombardier Capital Inc. and Bombardier Services Corp.
-Embraer-Empresa Brasilieire de Aeronautica S.A, Embraer Aircraft Maint. Services Inc., Embraer Aircraft Customer Services, Inc. and Michael Lewis Co.
-Bank of Hawaii
-Bank of America, National Association, as successor to Fleet National Bank
-AT&T Capital Services, Inc., f/k/a Ameritech Credit Corp.
-Universal Asset Management, Inc.
-Aircraft Solutions CRJ-200LR, LLC
-Aircraft Solutions ERJ-145, LLC
-Transamerica Aviation LLC and Transamerica Finance Corp.
-Wells Fargo Bank, N.A. and Wells Fargo Equipment Finance, Inc.
-Willis Lease Finance Corp.
-Wilimington Trust Co.
-United Airlines
-U.S. Bank National Association
-M&T Bank
The objectors are:
-Integra Bank, N.A. and IBNK Leasing Corp.
-Cargill, Inc.
-Zions Credit Corp
These three parties are primarily objecting not to the rejection of leases but to the condition of the returned aircraft, engines and equipment, etc.
A hearing is scheduled for tomorrow with this issue on the agenda. MAG argues that bankruptcy precedent is on their side and these lessors can basically collect their aircraft "as is". It appears as though the three objectors are up against the wall with this one.
On another note. United objects to MAG abandoning aircraft under contract prior to certain dates. United claims that it "relies on the use of the Aircraft in the operation of its business". They want MAG to park 26 CRJ-200's and 10 Dash-8's but on United's schedule.
Here is United's scheduled needs for MAG:
14 CRJ-200's and 6 Dash-8's until February 28th
10 CRJ-200's and 4 Dash-8's until April 30th
United wants MAG to go away, but not quite yet, ha! Good luck XJT, Enjoy! Don't forget "United eats it's young".
