C5's got it right. The the law has NOT been litigated yet so who knows how the first one will go down. Though it'll set a precedent for future mergers.

Career expectations is (was) an ALPA term, but I bet it'll be incorporated into any defense.

IMO, the law of unintended consequences may mean LESS mergers in the future (which may be good for the industry as a whole). However, this law may result in more furloughs because an airline just closes up shop vice being bought before ch 7 liquidation. Nothing is free.

Just my opinion though; I do not claim to be an expert.
