Some employers prohibit prosecution of a customer unless the employee is compelled to do so under subpoena. Almost all employers frown on prosecution of a customer.

I don't know what American's policy is, but seeing as how they launched their corporate attorneys on kids playing Microsoft Flight Simulator (alleging copyright infringement for making airplanes in AA colors), nearly anything is possible with them.
