As long as there is not enough damage to constitute an accident. I don't think ASAP covers accidents.
Also the FAA usually busts people for sterile cockpit in situations like this...sterile violations are consider willfull so no asap help there. Of course it's theoretically possible they were in 100% compliance with sterile...
