"Who knows" would be a good answer to the first question. I would hope that the Union would recognize the impossibility factor in attempting to determine exactly who was damaged and how much damage was done.
Better yet, who gets to decide? I'm sure the company would love to make ALPA prove every case, thus stretching out the process 'til doomsday. I still have two NCC's outstanding from the BUSH 41 administration.
