Default The great 135 question - on duty or not?

It has been glanced at a few tmes on this board, but thought I would get you guys talking about it a little more specific.

Does your duty time start when you are "available" to fly?

You hear it all the time, these part 135 company's having a guy on call 24/7. He only starts his duty time when he is called for a flight. His 24 hour rest days are the days he doesnt fly at all. No actual scheduled days off. According to the FAR's and a few letters I have sen from teh FAA, this mentality is illegal.

Even if you sit on your duff and watch TV for 12 hours waiting for a call to fly, you are on duty. This is because you cant really do anything else exccpet be ready to fly for that 12 hours. No beer, No rest.

What say you?
