I know from experience. I have been removed from a trip for "violating" this section of the CBA and yes, I made it to MEM and was available for the assigned trip.
Did you contact Contract Enforcement? It's my understanding there was a similar situation settled to the pilot's favor rather summarily - company lawyers agreed and everything.
